Terms of Service

These Terms govern your purchase and use of Tails & Tales Studio and its upgrades (together, the "Product"), operated by Luci Emma ("we", "us", "our"). By buying or using the Product you agree to them. If you do not agree, do not use the Product.

1. What the Product is

The Product is a web application that turns traditional fairy tales into funny, warm comic stories. It writes text only: image prompts, video prompts and edit plans, captions, listings and other text. It does not draw, render or generate images or video and does not include any AI service. To turn a prompt into a picture or a clip you paste it into your own account with a third-party tool such as ChatGPT, Gemini, Midjourney, Kling or CapCut. Those accounts, their costs and their rules are yours to manage.

The optional upgrades — Style & Story Vault, Reels & Shorts, Content Autopilot, Etsy & KDP Publisher, Tale Creator & Learning Pack — add features to the same app and are covered by these Terms.

2. Your licence

• Your purchase gives you a personal, non-exclusive, non-transferable licence to use the Product. The software is licensed, not sold.
• One licence is for one person. Each upgrade unlocks on the same licence key and email.
• You may not share, resell, sublicense or publish your licence key, or give others access to your account.
• You may not copy, redistribute or resell the Product itself or its content library — the stories, panel scenes, humor styles, art style descriptions, hooks, templates or any other data inside it — as a product, template pack, course or competing tool.

3. What you create is yours

The prompts and text the Product writes for you, and the images, videos, books, printables and posts you make from them with your own tools, are yours. You may use them commercially — post them on your pages, sell them on Etsy or Amazon KDP, print them — with no further payment to us and no credit required.

You are responsible for what you create and publish, including following the rules of each platform you post or sell on (among them their current rules on AI-assisted work) and the terms of the AI tools you used.

4. Fairy tales and original twists

The Product is built on traditional fairy tales, fables and folk tales that are in the public domain, retold with original twists. Tales you add yourself with Tale Creator must be public domain or your own original work; you are responsible for that choice.

5. Original characters, and the limits of our safeguards

Art styles in the Product are described only by technique — never by naming an artist, film, studio or brand — and its content avoids known characters and brands.

These are safeguards, not a legal guarantee. They reduce risk; they cannot promise that anything you create is free of third-party rights, and they are not legal advice. AI tools can still produce something that resembles existing work, so check what you make before you publish or sell it. You remain responsible for what you publish and sell.

You agree not to use the Product to deliberately recreate or trade on an existing copyrighted or trademarked character, brand or person.

6. Classroom material

The Learning Pack writes worksheets, lesson plans and questions for children. An adult — a teacher or parent — is responsible for checking any activity before using it with children, including cutting and craft activities.

7. Acceptable use

Do not use the Product to create unlawful, hateful, harassing, sexually explicit or deceptive material, or anything that impersonates a real person or organisation. Do not attempt to break, probe or overload the service, or to extract its content library by automated means.

8. Availability and changes

The Product checks your licence online and needs an internet connection from time to time. We aim to keep it available, but we cannot promise uninterrupted access, and hosting, features and content may change over time. Access depends on a valid, unrevoked licence. Your own work is stored in your browser; keep a backup file.

9. Payment and refunds

Payments are handled by our marketplace and payment partners and are also subject to their terms. Our refund terms are in the Refund Policy.

10. No income promise

Nothing in the Product or on this Site is a promise of earnings, followers or views. See the Earnings Disclaimer.

11. Disclaimers and liability

The Product is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. To the fullest extent permitted by law, our total liability arising from the Product is limited to the amount you actually paid for it. We are not liable for indirect or consequential loss, including lost profits, lost sales, lost data or the suspension of a social media account.

12. Ending access

We may suspend or end your access if you break these Terms, share your licence key, abuse the service, or reverse a payment after receiving the Product. Where access ends because of a refund or chargeback, the licence ends with it.

13. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Where mandatory consumer protection law in your own country gives you greater rights, those rights are not affected.
