Terms of Service

These Terms govern your purchase and use of Hero Comic Prompt Studio (the "Product"), operated by Luci Emma ("we", "us", "our"). By buying or using the Product you agree to them. If you do not agree, do not use the Product.

1. What the Product is

The Product is a web application that writes text prompts. It does not draw, render or generate images, and it does not include any AI image service. To turn a prompt into a picture you paste it into your own account with a third-party tool such as ChatGPT, Gemini or Midjourney. Those accounts, their costs and their rules are yours to manage.

2. Your licence

• Your purchase gives you a personal, non-exclusive, non-transferable licence to use the Product. The software is licensed, not sold.
• One licence is for one person, usable on up to 5 devices. You can release a device slot yourself inside the app.
• You may not share, resell, sublicense or publish your licence key, and you may not give others access to your account.
• You may not copy, redistribute or resell the Product itself or its content libraries — the joke engines, theme packs, style descriptions, blocklist or any other data inside it — as a product, template pack, course or competing tool.

3. What you create is yours

The characters you build, the prompts the Product writes for you, and the images you then generate with your own AI tool are yours. You may use them commercially — sell them on Etsy, print them on products, publish them on Amazon KDP, post them on social media — with no further payment to us and no credit required.

You are responsible for what you create and publish, including making sure it complies with the rules of the platform you sell on and the terms of the AI tool you used.

4. Your account and saved work

Characters and prompts you save are stored on our server so they follow you between computers. You can delete them at any time. We may remove content that breaks these Terms or the law.

5. Original characters, and the limits of our safeguards

The Product is built to help you create original characters. Art styles are described only by technical attributes — linework, shading, palette, texture — never by naming an artist, film or studio. Character names are checked against a blocklist, and certain colour and emblem combinations raise a warning.

These are safeguards, not a legal guarantee. They reduce risk; they cannot promise that anything you create is free of third-party rights, and they are not legal advice. You remain responsible for what you publish and sell. If you are unsure about a specific character, take professional advice.

You agree not to use the Product to deliberately recreate, imitate or trade on an existing copyrighted or trademarked character, brand or person.

6. Acceptable use

Do not use the Product to create unlawful, hateful, harassing, sexually explicit or deceptive material, or anything that impersonates a real person or organisation. Do not attempt to break, probe or overload the service, or to extract its content libraries by automated means.

7. Availability and changes

The Product is an online service. We aim to keep it available, but we cannot promise uninterrupted access, and hosting, features and content may change over time. Access depends on a valid, unrevoked licence.

8. Payment and refunds

Payments are handled by our marketplace and payment partners, and are also subject to their terms. Our refund terms are set out in the Refund Policy.

9. No income promise

Nothing in the Product or on this Site is a promise of earnings. See the Earnings Disclaimer.

10. Disclaimers and liability

The Product is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. To the fullest extent permitted by law, our total liability arising from the Product is limited to the amount you actually paid for it. We are not liable for indirect or consequential loss, including lost profits, lost sales or lost data.

11. Ending access

We may suspend or end your access if you break these Terms, share your licence key, abuse the service, or reverse a payment after receiving the Product. Where access is ended for a refund or chargeback, the licence ends with it.

12. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Where mandatory consumer protection law in your own country gives you greater rights, those rights are not affected.
